The judge exercised discretion under High Court Rules r17.85 to decline committal because the arrested respondent gave a clear undertaking not to return to the land, the applicants accepted that undertaking and did not seek imprisonment; consequently the arrested respondent was released and the arrest warrant for the absent respondent was not executed at this stage, with clear warning that future breaches would attract arrest and possible imprisonment.
