Because the criminal prosecution of the first named plaintiff raises the same critical factual issues and is likely to be influential or determinative of the civil claims, and nothing would be gained by further steps in the civil litigation while the criminal case remains pending, the High Court ordered an interim stay of the civil proceeding until conclusion of the criminal prosecution, with leave to recall if new material is shown.
