Absent expert evidence or an otherwise obvious methodological flaw, the court will not overturn Dr Todd's impairment assessment; the appellant did not demonstrate a flaw in the assessment or apportionment and the appeal is dismissed.

The appeal is dismissed because the assessor applied the prescribed assessment tools (AMA Guides) in a manner consistent with the records and peer review, pain was considered within the nerve injury rating, and the appellant produced no expert evidence or self-evident error to overturn the 14% WPI assessment.

The assessor applied the AMA Guide (4th ed.) and the statutory/regulatory scheme correctly; the objectively assessed Whole Person Impairment was 8%, below the statutory 10% threshold, therefore the Corporation lawfully cancelled the appellant's Independence Allowance and the appeal is dismissed.
