Non-party discoveror (Christopher Sukkel and CJ CAD Services Ltd) is entitled to recover actual and reasonable costs but the court will assess quantum afresh. Applying a clean-slate assessment the court fixed legal/solicitor hours at 37 hours at $250/hr and secretarial work at 93 hours at $75/hr, awarded legal expenses of $16,225 plus Mr Sukkel's own expenses of $2,141.55 (GST exclusive), made a $2,000 deduction for delay, and ordered plaintiffs to pay $16,366.55 to Mr Sukkel/CJ CAD Services Ltd; GST excluded because CJ CAD is GST registered.
