Because the respondent advanced inherently implausible and unmeritorious defences and gave evidence lacking credibility that unnecessarily increased the time and expense of the restraining order proceeding, the Court exercised its discretion to award increased costs on a 2B scale with a 50% uplift, plus disbursements, totaling $32,623.50.

The Court, exercising its power to preserve assets pending further order and to clarify uncertain earlier orders, confirmed on an interim basis a freezing order over the specified ANZ term deposits, the property at 854 Colombo Street, and the proceeds of sale of 67 Augusta Street held by the Official Assignee, restrained removal or disposal of those assets pending further order, and discharged the 8 November 2007 undertaking of Ms Sisson as superseded.

Given communications between counsel and the sworn affidavit denying any intention to abscond and asserting rents were up to date, there was no proper basis to grant the extreme freezing and travel restraint orders sought; the applicants withdrew the application and the Court awarded costs to the respondents.
