The Court approved the s95 settlement because it met statutory requirements: the settlement advanced the purposes of the Criminal Proceeds (Recovery) Act and the overall interests of justice by securely forfeiting tainted funds to the Crown, saving time and cost, providing certainty, and recognizing practical enforcement limits on profit forfeiture; accordingly assets forfeiture and directed release orders were made and costs were left to lie where they fall.
