Judge held that Gough's delay justified lifting the stay absent safeguards but exceptional circumstances and mitigation justified one final conditional indulgence: the stay will continue only if Gough assigns his interest in the Top Energy easement compensation to Walsh and files an application for leave to appeal out of time by 9 May 2022; failure will automatically lift the stay allowing Walsh to enforce the judgment and charging order.
