Given the statutory language of s160(2)(a) and s179(b) of the Crimes Act and analysis under the NZBORA the Court concluded that a medical practitioner who administered or made available a fatal drug in the described circumstances would be at real risk of prosecution for murder, manslaughter or assisting suicide; therefore the Court could not grant the declarations sought and only Parliament can authoritatively change the criminal law to permit the conduct.
