The court held it could not grant the criminal-law declarations sought: a doctor who intentionally administered a fatal drug would risk culpable homicide under s160 and a doctor who supplied a fatal drug knowing it would be used to end life would risk prosecution under s179; ss160 and 179 are enacted grounds established by law, s8 is engaged but not breached (not arbitrary, overbroad or grossly disproportionate), s9 is not engaged; reform is for Parliament, not the courts.
