The application to allow Mr Xu to give evidence by AVL was granted because the AVL technology was adequate, Mr Xu is permanently resident overseas, and the allegations of prior or prospective police coercion lacked cogent independent support (complainant not independent, lack of detail, absence of corroboration and no country evidence of systemic coercive practice); thus fairness concerns were insufficient to require in‑person attendance, while preserving the right to raise objections at trial.
