Band C was appropriate for commencement given the extensive file and complexity, and a 50% uplift to scale costs was warranted because the proceeding was of general importance, involved substantial work to vindicate a BORA right (arbitrary detention), and counsel's efforts were necessary to secure the applicant's release; therefore the costs claimed in counsel's memorandum of 19 February 2021 and agreed disbursements were ordered.
