On the material before the court the statutory criteria for interim restraining orders under the Proceeds of Crime Act 1991 were satisfied (reasonable grounds to believe the offence was committed, a benefit was derived and the Kohimarama house and trust were under the respondent's effective control); accordingly interim restraining orders were granted, the Official Assignee was appointed to take custody and control subject to specified conditions including limited authorised payments and occupation permissions, and service on interested parties effected to date was declared sufficient.
