The Ombudsman had completed her investigation and advised the Bank she did not have jurisdiction before the Bank issued proceedings on 15 March 2013; therefore the Bank was entitled to commence proceedings and the protest to jurisdiction had no merit. On the evidence there was no arguable defence and summary judgment was properly entered for the Bank for the claimed sums with continuing default interest.
