The claim was struck out because any cause of action vested in the Official Assignee on the plaintiff's adjudication in bankruptcy and remained with the Assignee until the Assignee is released under s408 of the Insolvency Act 2006; the plaintiff therefore lacked standing, and additionally the statement of claim was unintelligible, prolix and disclosed no tenable cause of action causing prejudice and delay.
