Applying Erceg v Erceg factors, the court refused to order the broad disclosure sought because the Trust was settled primarily for the care and financial security of the vulnerable beneficiary (Annette), there was no evidence of breach, significant confidentiality and practical retrieval concerns existed, limited relevant documents had already been provided, and disclosure would be unduly intrusive and likely to provoke further familial litigation.
