Extension of time to apply for leave to appeal was dismissed because the applicant failed to demonstrate adequate explanation and compelling reasons; Berkland did not alter his position as he remained within the amended significant role profile, co-defendant differences in culpability justified disparate starting points, tikanga did not change the outcome, and there was no real risk of miscarriage of justice.
