Because service was proved, no appearance or defence was filed, the vessel's owner was in liquidation and had disclaimed interest, and the vessel posed deterioration and environmental risk, the court entered default judgment for unpaid berthage fees, interest and costs and ordered appraisement and sale by the Registrar to preserve the res and permit recovery of sums due; an appraisement was required to assist and protect the Registrar.
