Imposition of the statutory maximum seven years would be so disproportionately severe given the notional end sentence of 14 months, the causal link between the offender's chronic schizophrenia and the offending, and the offender being an inadvertent casualty of the three strikes regime; therefore s86D should not be applied and the defendant is sentenced under ordinary principles to 14 months' imprisonment with specified release conditions.
