The Court was satisfied on the affidavits that the applicants have a good arguable case on the building defects and vendor warranty claims, there are assets (the Broughton apartment and sale proceeds) available to satisfy any judgment, and there is a real risk those assets would be dissipated by an imminent sale; accordingly a freezing order and ancillary relief including transfer of the District Court proceedings to the High Court were granted.
