Applicant entitled to costs. Item 41 (preparation of the bundle) was reduced by half (0.3 days) because the respondent prepared the bundle of documents; total time allowed 4.45 days at $2,390/day = $10,635.50 plus disbursements of $1,107.48, total $11,742.98 payable by respondent to applicant.

Second counsel was certified given factual and legal complexity; an additional modest half day for bundle preparation was allowed because responsibility rested with the applicant and the respondent incurred legitimate additional work; a 50% uplift to scale costs was not warranted because the material did not show prejudice or fundamental lack of merit or otherwise justify uplift. The respondent (Maria Johnson) was ordered to pay specified costs and disbursements.

Costs were fixed on a 2B basis; certification for second counsel was declined because the matter was straightforward and a single counsel sufficed; the common bundle was prepared by Smartpay so BNZ could not separately claim for its preparation; Smartpay was obliged to file a statement of defence under r 12.4(3) and (4) and is entitled to recover 2B costs for that step; accordingly OHQL ordered to pay BNZ $8,365 plus disbursements $1,130.43 (total $9,495.43) and Smartpay $15,057 plus disbursements $1,519.64 (total $16,576.64).

The Court declined to award costs for the costs memorandum, awarded Hortiventure one-quarter of the costs for bundle preparation, and awarded Hortiventure 75% of $3,980 (i.e. $2,985) for the notice in opposition and supporting affidavit; costs in the strike-out decision were on a scale 2B basis.

The High Court exercised its case management discretion to issue specific pre-hearing directions: allocate two days' hearing time, fix costs category 2B, refuse security for costs given three related appeals, require provision of the Weathertight Homes Tribunal transcript and impose a detailed timetable for points of appeal, bundle preparation, filing of submissions and responses, with equal sharing of reasonable bundle preparation costs.
