The Court accepted the appellant's account that a traumatic fall occurred on 12 July 2011 and preferred the operating surgeon's opinion that the posterior horn meniscal tear was caused by the twisting injury; CAP's contrary conclusion was undermined by misapprehension of the accident history and did not displace the surgeon's direct operative findings; accordingly the revocation was quashed and cover for the meniscal tear reinstated as the appellant proved causation on the balance of probabilities.
