Defendant failed to prove a breach of s176 because there was no evidence the alleged Chin purchaser's interest existed or was communicated to the lender before the unconditional sale on 3 May 2016; proposed late pleadings under the CCCFA and penalty interest were refused because they were late, prejudicial, required additional evidence and discovery, and did not serve the interests of justice.
