The Court held the appeal is confined to the respondent's 15 August 2006 decision which merely reinstated an earlier, binding entitlement determined on 12 September 2000; the Reviewer was correct that he had no jurisdiction to reassess the quantum of weekly compensation on that review; however the Court directed a fresh review to determine whether the appellant is entitled to the minimum weekly payment under Clause 42 Schedule 1 of the 2001 Act from 1 April 2002 pursuant to transitional provisions (ss 363,365,366).
