The Judge exercised discretion to reserve costs on the discontinued summary judgment application because it was premature to fix costs before the final determination: BSC was entitled to test Sargon's fraud allegations in interlocutory proceedings and its withdrawal was responsible; accordingly costs are reserved to be decided at the final hearing.
