The plaintiff's application for further and better discovery was dismissed; the first defendant, as the successful party, was awarded costs on a 2B basis. The court allowed item 11 (memoranda) because the exchange addressed genuine interlocutory case management matters despite no formal conference, but disallowed item 29 (sealing of order) as unnecessary given dismissal. The appropriate costs award was fixed at $7,170 plus disbursements of $110.

Costs for defending the interlocutory application are to be assessed under Schedule 3 step 4.13 (not step 2) because preparation of opposition and affidavits is encompassed by that step; memoranda for case management and mentions are recoverable under step 4.10; accordingly Comanche is entitled to $960 under step 4.13 and $1,920 under step 4.10.
