The appeal was filed more than 20 working days after the Family Court order dissolving the marriage; s174(4) of the Family Proceedings Act 1980 bars the High Court from extending the time for such appeals; therefore the Court had no jurisdiction to validate the late appeal and it must be struck out; conversion to a Part 11 case stated appeal was not available.
