The court extinguished both the first covenants and the second (fencing) covenant because the land has been rezoned and the neighbourhood character has become residential, the covenants are obsolete or have expired/do not enure to successors, they would impede reasonable residential subdivision, and service requirements on the named respondents had been satisfied or properly addressed.
