Expert evidence established significant and widespread defects; applying the Tisch three-stage approach the Court was satisfied the building was damaged, a s 74 scheme was appropriate given the scale and mixed common/private nature of works, and the proposed scheme was fair, detailed and consistent with statutory requirements; accordingly the Court approved the scheme.
