Because medical practice and social welfare changed materially since 1911 the original trust limited to incurable disease and institutional care had become inexpedient; the proposed scheme to broaden the charitable purpose to hospitals or homes for persons primarily the poor suffering illness or disability and to modernise trustee powers was itself charitable, lawful and would facilitate administration, and therefore the Court granted the application under ss 32 and 33 of the Charitable Trusts Act 1957.
