On the balance of probabilities the 1979 lifting injury was a significant lumbar injury that initiated ongoing symptoms; the 2007 accident aggravated that covered 1979 injury and the ACC decision attributing incapacity to an earlier 1972 event or age-related degeneration was wrong. The appeal is allowed and the matter remitted for determination of the start date of incapacity.
