The judge found the respondent's prior consideration was too narrow and referred the matter back to the Corporation to exercise its discretion under Clause 39 of the First Schedule, requiring a wider assessment of the claimant's need for a vehicle and his financial position; accordingly the appeal was adjourned sine die pending that reconsideration.
