Leave to appeal was refused because the applicants had insufficient prospect of success: the debarment for persistent and flagrant discovery non-compliance was proper, concurrent findings of fact established Mr Noe's awareness and responsibility for the default, there was no demonstrated breach of natural justice, and no miscarriage of justice requiring further appeal.
