The Court declined to order the proceeding to continue as a representative action but granted a Stage 1 trial on a subset of common issues; because plaintiffs were partly successful the appropriate costs award on their interlocutory application was scale 2B reduced by 60%, with filing fee disbursement awarded in full, producing a costs award to plaintiffs of $3,354.40; the Court refused to overturn earlier costs orders made by another Judge and reserved costs on the defendant's discovery application, granting the defendant leave to file a short memorandum on costs.
