LBC's costs application is dismissed because, although delay alone without demonstrated prejudice was insufficient to bar the application, LBC lacked a legitimate interest in the outcome of the directions proceeding (its interests were adverse as a potential debtor) and therefore was not entitled to be regarded as a successful party for costs; policy considerations about not deterring liquidators reinforced that outcome though they were not determinative.
