The Court will award costs to the liquidators on a 2B basis treating the defended interlocutory application as if it were an originating application; the affidavits challenged were necessary and their costs are allowed; hearing time for 18–19 March 2014 is to be calculated at 0.25 of a day for the relevant items (item 42).

Because material documents and adequate direct explanations from the respondents were lacking and many explanations were provided only orally by counsel, the Court exercised its s266 powers to order production of specified categories of documents and a single MYOB data file, while allowing respondents to file affidavits if documents do not or no longer exist and permitting the liquidators leave to seek further directions on MYOB retrieval; costs were awarded to the liquidators on a 2B basis.
