The Home's capital has reduced to a level making continuation non‑viable and that reduction was the result of the lawful exercise of its charitable objects; accordingly it is just and equitable under s25 Charitable Trusts Act 1957 to appoint a liquidator and wind up the incorporated charitable trust, and under s27 the court will direct that any surplus after liabilities be gifted to a charity (CCS Disability Action) compatible with the Home's objects.
