The Court found the applicant's legitimate expectation cause had a material Auckland dimension (meetings, correspondence and interviews in Auckland with the Binnie inquiry and officials) and therefore filing in Auckland was proper; even if filing had been in the wrong Registry, the Court would exercise its discretion under HCR 5.1(4) to decline transfer to Wellington as there was no compelling reason to move the proceeding.
