The Court exercised its discretion to refuse the liquidation order and dismissed the proceeding because the plaintiff, having received notice of a proposed s230 compromise which was declared approved by postal vote, could not in the court's view properly proceed with a liquidation application in the face of that approved compromise; the Court also struck out a purported defence filed by a non‑solicitor and declined to determine the ultimate validity of the compromise in this liquidation proceeding.
