Judge found on balance that the appellant suffered injury in the 10 October 2015 accident and that available evidence, including clinical improvement after treatment from Dr Burling and unchallenged statements about MRI sensitivity, supported a causal link; accordingly the Corporation did not have a sufficient factual basis to suspend entitlements as at 30 January 2017 under s117 and the appellant was unable by reason of personal injury to engage in her pre-injury employment under s103(2). The Corporation's decision to suspend and decline weekly compensation was set aside.
