Deliberate and prolonged refusal to maintain a controlled drug register and SOPs undermined the statutory regime for protecting public health and the integrity of professional self‑regulation; cancellation was disproportionate but censure insufficient; a six month suspension (deferred three months) with 12 months of defined conditions and completion of the NZ Pharmacy Legislation course is the proportionate penalty, and costs awarded by the Tribunal should stand with the appellant's trial‑level appellate success attracting a one‑third reduction of his liability for Court costs.
