Because the s 26A pre-sentence report and supplementary information addressed the Department's reservations and the Crown did not oppose, the Court confirmed the substituted sentence of 12 months' home detention to commence 30 November 2020 at the approved address with the specified standard and special conditions; bail is revoked from that date.

The Court concluded the 21 month prison sentence was excessive in the circumstances and that an eight month home detention order with specified standard and special conditions better served the purposes of sentencing, including rehabilitation and protection, and therefore substituted that sentence for imprisonment.

Given the Court's earlier conclusion that substitution would be appropriate subject to a suitable home detention residence report, and in light of the satisfactory residence report received, the Court quashed the sentence of imprisonment and substituted a four-month term of home detention with specified conditions to manage risk and promote rehabilitation.
