The Court applied the general discretionary approach to costs under r14.1(1) and refused to adopt any fixed rule excluding s 327 applications; on the facts the defendant's expert valuer unreasonably prolonged and complicated the hearing, causing additional costs, so the successful plaintiff was awarded 2B costs and recoverable disbursements (except abandoned helicopter hire).
