On the available evidence RFD established a genuine and substantial dispute under s290(4)(a) as to whether the $80,000 was owing to Sol because the factual matrix supported a tenable claim that Sol acted as a conduit for THL under common control; the Associate Judge's decision to set aside the statutory demand was not shown to be wrong; applications to adduce additional fresh evidence on appeal were refused as not cogent or proportionate.
