The applications were declined. The Court held that while the Crown solicitor possessed the reports, release to police for investigation while related judicial proceedings (including a Crown appeal) remain live would risk undermining the integrity of the judicial process and the frankness necessary in sentencing assessments; access under the Rules or by exercise of inherent jurisdiction is therefore inappropriate at this stage.
