Under High Court Rule 8.21(2) the Court ordered NZICA to provide a list and to facilitate inspection of documents created in or arising out of its review of SCW's auditing because those documents relate to matters in issue and public policy confidentiality concerns do not override the parties' interest in disclosure; disclosure is subject to confidentiality undertakings and restricted inspection to mitigate public policy concerns.
