On the balance of probabilities appellant failed to establish undue hardship under s129EA because evidence showed she paid for the vehicle while knowing a disqualified driver would use it and that risk of confiscation existed, ownership transfers suggested attempts to facilitate a disqualified driver using the vehicle, and available statutory remedies (security interest procedures and proceeds application) meant any hardship was not 'undue'.
