- High Court
The Court held it has inherent jurisdiction to consider applications for audit consistent with s 83B but s 83B and the inherent jurisdiction are limited to conventional audits of trust accounts; the plaintiff's application for a broad investigative review and for appointment of the named auditors/reviewers (and for a court expert) was dismissed as beyond s 83B's scope, unlikely to resolve important issues, and inappropriate absent agreed questions or proper statutory application to Public Trust; plaintiff may instead apply to Public Trust under s 83B for a conventional audit.
