The Court held that plaintiffs could not, as of right after commencement, add Gold Band and Delta simply by filing an amended statement of claim; r 4.56 governs post‑commencement joinder. Because not all affected parties had unqualified consent under r 1.8, the Court exercised its r 4.56 discretion to order that Gold Band and Delta be added as defendants but directed that any application to be discharged or to strike out be filed within 10 working days.
