The plaintiffs, despite having a right to refuse consent, persisted in opposing the defendants' application after Lang J had warned they faced increased costs and after Lang J had assessed the defendants as having a strong case; because the issues were not in dispute and the opposition lacked merit in those circumstances, the Court exercised its discretion to uplift the 2B costs by 50 percent.
