The appellant's challenge was misconceived and lacked merit; pursuing the appeal and related arguments was unnecessary and justified an award of indemnity costs, but the uplift was limited by the rule that costs awards must not exceed actual costs, resulting in an order that the appellant pay the respondent $21,963.00 in costs.

Appellant failed to establish any tenable defence or linked counterclaim: allegations of conflict of interest and a conspiracy were unsupported, inherently improbable and irrelevant to the unpaid-fees claim; affidavits and evidence sought to be adduced were not probative; therefore summary judgment for the respondent for unpaid fees was correct, leave to adduce further evidence was refused, but leave to file the appeal one day late was granted; the District Court's costs award (2B plus 50% uplift) was appropriate.
